Legislation according to ‘product-type’
The legislation distinguishes between 23 different types of product, including disinfectants, preservatives (including wood preservatives and slimicides), pest control products (including rodenticides and insecticides) and antifouling products. The product must fall within one of the 23 product-types in order to be considered as a biocidal product.
Once an active substance has been approved by the EU for a particular product-type, it can be used in all products of that type, but not for other purposes. For example, an active substance that has been approved for use as an antifouling product must not be used for other purposes.
Transitional period
Even before the Biocidal Products Directive had entered into force, Denmark had an authorisation scheme covering some of the 23 product-types. These products must still be authorised in accordance with the existing Danish rules while the transitional period is in force and the EU is evaluating the active substances in the products.
