Classification – new plant protection products

New products where applications are submitted after 14 June must be classified under the Classification Regulation. Up to 1 June 2015, however, classification may be undertaken according to the Dangerous Preparation Directive.

The applicant for authorisation of a product must inform the Environmental Protection Agency of the chosen regulations for classification when submitting the application.
With regard to applications for new products before 14 June, the applicant may request classification according to the Classification Regulation if this was not requested at the time of the application. Classification will otherwise be in accordance with the provisions of the Dangerous Preparation Directive.

If classification takes place in accordance with the Classification Regulation, the product must be labelled and packaged in accordance with that regulation. In addition to the provisions of the Classification Regulation, the provisions of the Pesticide Regulation with regard to labelling and packaging must be observed (see below).

After the granting of the authorisation, the authorisation holder is responsible for updating the classification and labelling of the plant protection product. Changes to classification must be submitted to the Environmental Protection Agency. A change in classification or reclassification may result in a need for a new authorisation.

Classification – existing plant protection products

In connection with the re-evaluation of plant protection products on the market before 14 June 2011, the applicant may until 1 June 2015 choose to classificy in accordance with the old provisions of the Dangerous Preparation Directive or the new CLP provisions of the Classification Regulation.
When applying for the renewal of an authorisation, the applicant must indicate which regulations were used for classification.
With regard to applications for re-evaluation that have already been submitted, the applicant may request classification according to the Classification Regulation if this was not requested at the time of the application. Classification will otherwise be in accordance with the provisions of the Dangerous Preparation Directive.
